MAGISTRATE FORECLOSURE CASES
All documents that the Judge or Magistrate would sign should be in Word format. These will be emailed only to: If they go to any other email, they may get deleted. Do not "CC" any Judicial Assistant's on these.
If this is a MSJ or NJT, three SEPERATE documents are needed: 1) Report and recommendation with a copy of the Final Judgment attached and labeled "Exhibit A" 2) an Order Adopting Report and 3) the Final Judgment.
The case number must be listed in the name of the attachment.
Please make sure that on the copy of the Final Judgment attached to the Magistrate's Report, the Final Judgment, and the Order Adopting, all have the signature line for Judge Ketchel. Also, our Administrative Directive MUST be on all documents the Judge signs.
The Administrative Directive that has been in place in Okaloosa County since 04/2016 and should be on all documents the JUDGE signs is as follows: "In cases wherein one party is unrepresented (pro se), it is the responsibility of the sole attorney in the case to serve within five business days this order or judgment upon any pro se party who does not have access to nor is a registered user of the Florida Courts e-filing Portal.
Do not send until there is confirmation that the hearing took place. Sometimes, hearings get reset or the language in the Report needs to be changed. This keeps us from accidently filing the wrong report.
In the body of Orders Setting Hearings, please include who the hearing is set before.
